Understanding Impeachment: The Constitution's Role

Back in January 2020, the topic of impeachment was all over the news, causing a lot of confusion. But when it comes to getting the facts about impeachment in the American government and history, the United States Constitution is the go-to source. It explains everything clearly and directly.

Impeachment: Looking Back

Impeachment has a long history in the United States. The Founding Fathers put it into the Constitution as a way to hold powerful people accountable for their actions. They wanted to make sure that nobody, no matter how important, could break the law without consequences. So, they set up a detailed plan for impeachment.

What the Constitution Says

The Constitution tells us exactly how impeachment works in Articles I and II. It says that the House of Representatives can impeach, and the Senate can hold trials for impeachment. The Constitution also says that the President, Vice President, and certain government officials can be impeached for "high Crimes and Misdemeanors." This phrase might sound complicated, but it's meant to be flexible and adapt to different situations.

Step 1: The House of Representatives

Impeachment starts in the House of Representatives. Members can accuse someone by introducing and voting on articles of impeachment. This is like the first step in a legal case to see if there's enough evidence to proceed. In the House, a simple majority vote is all that's needed to impeach.

Step 2: The Senate

After the House impeaches someone, the case moves to the Senate. The Senate acts like a jury in an impeachment trial. The Chief Justice of the Supreme Court oversees the trial for the President, but for others, the Senate makes the rules. To remove the impeached person from office, a two-thirds majority vote in the Senate is necessary.

The End Result

If the Senate convicts the impeached person, they get removed from office. The Senate can also decide to prevent them from holding any future offices. Importantly, impeachment doesn't always lead to criminal charges. Its main purpose is to protect the integrity of the office and the country.
